A foreigner accesses Balinese land through two legal routes: a notarized leasehold (a long lease of 25 to 30 years, often renewable) or holding a Hak Guna Bangunan through a PT PMA (foreign-owned company). The Hak Milik title, the equivalent of a freehold, has been reserved for Indonesian citizens since the Agrarian Code of 1960.

The classic trap is the nominee arrangement, where an Indonesian holds the land on behalf of the foreigner through a side agreement. This arrangement is legally void: Indonesian case law has repeatedly confirmed outright annulment, with loss of both the land and the price paid.

According to Bank Indonesia, the commercial property price index in Bali climbed +8.46% in the fourth quarter of 2024, which mechanically increases the value of long-term titles. The leasehold suits personal use or short-horizon semi-rental: low ticket, clean exit at the end of the lease, few accounting obligations. The PT PMA + HGB is the obvious choice for rental: 30 years renewable 20 + 30, easier resale, transferable structure.
